China's Ministry of Commerce published an interpretation on September 1 of new guidance for overseas competitive conduct and compliance in the automotive sector. The document provides general reference for Chinese automotive companies conducting international production and business activities. It covers overseas marketing and other competitive conduct alongside workplace safety, quality management, labor protection and data security.
The Ministry describes the guidance as practical and asks companies to adapt their work to applicable laws, antitrust policy, market principles and commercial practice in each location. Although the document is sector-specific, its operating model is useful to other manufacturers: market communication needs to be connected to the controls that make a promise true.
Marketing claims are part of operating conduct
An overseas website, distributor brochure, exhibition deck or social post creates expectations about a product and supplier. Statements about performance, origin, delivery, service, data handling or local presence should point to an accountable team and a current evidence version. Copy review alone cannot verify whether the factory, distributor and service organization can fulfill the statement.
The risk increases when channels adapt material locally without a shared source. A translation may remove a condition, an old brochure may retain a retired specification, or a distributor may broaden a service statement beyond its territory. Content governance should therefore include channel assets and not stop at the corporate domain.
Build a market-level compliance map
Use market, operating entity, product or service, channel and owner as the core identifiers. For each combination, record the official rule source, effective date, applicability, internal control, evidence owner and last review. Separate legal requirements from customer conditions, industry practice and voluntary company commitments.
The map is not a legal opinion and should not be presented as one. Its purpose is to tell commercial teams when a claim needs specialist review and which version is currently approved. A requirement that remains unclear should be marked unresolved rather than converted into confident public language.
Attach evidence to every material claim
Important claims can reference a controlled evidence ID: a specification sheet, test record, certification file, origin statement, service policy or approved market note. The content system should only draw from current versions. When a product, market rule or supporting document changes, dependent pages and channel assets should enter review.
The same design can cover quality, labor, data and safety. It allows the company to identify whether a marketing statement depends on a factory control, a processor agreement, a service partner or a local operating permit. Ownership becomes visible before a buyer or regulator raises the question.
What this means for Chinese exporters
International expansion is increasingly a continuing operating commitment rather than a one-time shipment. The automotive guidance illustrates that competitive conduct, production, quality, labor and data cannot be managed as isolated topics. A company can adopt the structure without claiming that automotive rules apply directly to every sector.
Marketing should own accurate expression. Product and operations should confirm capability. Compliance specialists should interpret applicable rules. Authorized management should decide material exceptions. This division of responsibility supports speed because the commercial team knows where to obtain a reliable answer instead of restarting a review for every asset.
Action checklist
- Create a market compliance map that distinguishes law, industry practice, buyer requirements and voluntary promises.
- Maintain one approved claim library for websites, advertising, exhibitions, distributors and sales conversations.
- Assign an evidence owner and review cycle for quality, labor, data, safety and after-sales statements.
- Check entity, market, product version, source, validity period and approval record before publication.
- Suspend a claim that cannot be verified or fulfilled locally; do not hide the gap behind vague wording.
- Include withdrawal and channel-notification steps in the release plan for high-impact material.
Use an exception ledger without normalizing exceptions
New-market work often begins before every document or route is mature. An exception ledger should record the missing evidence, affected markets and assets, interim control, accountable owner, due date and final disposition. It should not turn “publish first” into a permanent operating model.
Material exceptions require a person with the appropriate authority and a practical reversal plan. If a claim later proves inaccurate, the company should be able to identify every page, document and distributor asset that inherited it. That traceability connects compliance to execution instead of making it a final legal-editing stage.
